Acceptable Use Policy
1. Purpose and Scope
This Acceptable Use Policy (the "AUP") describes content and conduct that are prohibited on the Lecturia service (lecturia.ai, app.lecturia.ai, and the Lecturia iOS and Android mobile applications) (the "Service"), operated by [PLACEHOLDER: Lecturia, Inc.] ("Lecturia"). The AUP is incorporated into and forms part of the Lecturia Terms of Service. Capitalized terms not defined here have the meanings given in the Terms of Service.
Violation of this AUP is a material breach of the Terms of Service and may result in content removal, Account suspension, permanent Account termination, forfeiture of unused credits, and, in appropriate cases, referral to law enforcement.
Lecturia does not proactively review every file you upload. Lecturia enforces this AUP through a combination of (a) your representations and warranties in the Terms of Service, (b) content filtering performed by third-party TTS Providers as part of their own terms, (c) Lecturia's response to reports from Users, rightsholders, regulators, or law enforcement, and (d) automated abuse-detection signals. Lecturia's failure to detect or act on a particular violation is not a waiver of Lecturia's right to enforce this AUP in any other case.
2. Content You May Not Upload
You may not upload, submit, process, or generate any Content through the Service that falls into any of the categories in Sections 2, 3, or 4.
2.1 Content you do not own and have no right to use
You may not upload Content unless you own it or have a license, consent, or other legal basis sufficient to grant Lecturia the rights described in Section 6.2 of the Terms of Service. Specifically, you may not upload:
- Books, articles, documents, or other materials obtained from pirate sites, unauthorized file-sharing networks, cracked-ebook sources, or similar illegitimate distribution channels;
- Content for which you have only a read-only license that prohibits reproduction, conversion to audio, or transmission to third-party processors;
- Content protected by digital rights management (DRM) that you have circumvented or attempted to circumvent, including ebooks with Adobe ADEPT, Amazon KFX/KFM, Apple Fairplay, or similar protection stripped or bypassed;
- Content belonging to another person, including a family member, friend, colleague, or employer, without that person's permission and the permission of the underlying rightsholder;
- Content licensed only for a specific purpose inconsistent with text-to-speech conversion (for example, textbook excerpts licensed only for classroom display, or research papers licensed only for internal corporate use).
If you do not know whether you have the right to upload a particular file, you do not have the right to upload it.
2.2 Content that exploits or endangers minors
You may not upload any Content that:
- Constitutes child sexual abuse material (CSAM) as defined by 18 U.S.C. §2256, the EU Directive 2011/93/EU, or any equivalent law;
- Depicts, describes, or promotes the sexual exploitation, grooming, or sexualization of any minor, including entirely fictional or AI-generated depictions;
- Provides instructions, advice, or encouragement for contacting, grooming, meeting, or exploiting minors;
- Markets sexual services or products to or around minors.
Lecturia has zero tolerance for CSAM. Any such material will be immediately removed, the uploading Account will be permanently terminated, Lecturia will preserve the minimum evidence necessary to support law-enforcement action, and Lecturia will report the incident to the competent law-enforcement authority of the relevant EU member state and, where applicable, to the INHOPE international hotline network (https://www.inhope.org). When Lecturia expands to US users or otherwise establishes a US legal nexus, reports will additionally be filed with the U.S. National Center for Missing & Exploited Children (NCMEC) CyberTipline as required by 18 U.S.C. §2258A.
2.3 Illegal content
You may not upload Content that:
- Violates any applicable law, regulation, or court order, whether in the United States, the European Union, your country of residence, or any country where Lecturia or its TTS Providers operate;
- Facilitates, promotes, or constitutes a criminal offence, including terrorism, violent extremism, human trafficking, drug trafficking, illegal weapons trade, or money laundering;
- Is subject to export-control, sanctions, or embargo restrictions that would make its processing by Lecturia or a TTS Provider unlawful;
- Infringes, misappropriates, or violates any intellectual-property right, publicity right, privacy right, or contractual right of any person or entity;
- Constitutes defamation, libel, or a false statement of fact about an identifiable person or entity;
- Violates a non-disclosure agreement, trade secret, or confidentiality obligation.
2.4 Content that harms or harasses others
You may not upload Content that:
- Depicts or incites violence, torture, self-harm, or suicide, except in fictional or educational contexts that do not themselves violate this AUP;
- Targets a specific person or group with threats, harassment, stalking, or intimidation;
- Promotes hate, discrimination, or violence against a person or group on the basis of race, ethnicity, national origin, religion, disability, gender, gender identity, sexual orientation, age, veteran status, or any other characteristic protected by applicable law;
- Promotes terrorism, violent extremism, or organized hate.
2.5 Unauthorized use of real people's identity
You may not upload Content that:
- Impersonates a real, identifiable person in a manner likely to mislead (for example, uploading a transcript falsely attributed to a named public figure);
- Sexualizes a real, identifiable person without that person's express, verifiable consent;
- Uses a real, identifiable person's name, voice, or likeness in a manner that violates their rights of publicity or privacy.
2.6 Protected health information (HIPAA)
You may not upload any Content that constitutes "protected health information" (PHI) as defined by the U.S. Health Insurance Portability and Accountability Act (HIPAA) or its implementing regulations, or any equivalent category of health data under EU or UK law, unless and until you have executed a separate written agreement with Lecturia (such as a Business Associate Agreement) specifically authorizing that use. Lecturia is not a HIPAA Business Associate by default. Without such an agreement, your upload of PHI is a breach of this AUP and of the Terms of Service, and you -- not Lecturia -- are responsible for any resulting non-compliance.
2.7 Malware and harmful code
You may not upload Content that contains or is designed to deliver viruses, worms, trojans, ransomware, spyware, or any other malicious code, or that is intended to damage, disable, or interfere with the operation of the Service, a TTS Provider, or any computer system.
2.8 Synthetic personal data, spam, and deception
You may not upload Content that:
- Consists of mass-generated, automated, or low-quality text intended to abuse free-tier usage or defraud Lecturia's credit economy;
- Constitutes spam, unsolicited commercial messages, or promotional material intended for mass distribution;
- Is part of a scheme to deceive, defraud, or scam any person.
2.9 Personal data of other people
You may not upload personal data of other people unless you have a lawful basis under applicable data-protection law for that processing. Examples are CVs, letters, notes, human-resources or medical records, and contact lists. Section 6.3 of the Terms of Service sets out your warranty about the personal data in your Content, and Section 13 sets out your indemnity.
3. Uses of the Service That Are Prohibited
Regardless of the nature of the Content, you may not:
3.1 Security, integrity, and availability
- Probe, scan, or test the vulnerability of the Service, or attempt to breach its security or authentication measures, without Lecturia's prior written consent;
- Access, tamper with, or use non-public areas of the Service, Lecturia's computer systems, or the infrastructure of any TTS Provider or sub-processor;
- Interfere with or disrupt the Service, any server, or any network connected to the Service;
- Use the Service to launch, facilitate, or participate in a denial-of-service attack;
- Transmit any material that is designed to overload, flood, crash, or otherwise impair the Service;
- Circumvent, disable, or otherwise interfere with security-related features of the Service, features that prevent or restrict use or copying of any content, or features that enforce limitations on use.
3.2 Scraping, automation, and rate limits
- Use any robot, spider, scraper, or automated means to access the Service, except for (a) publicly documented APIs provided by Lecturia, used within their published rate limits and under Lecturia's published API terms, and (b) search-engine crawlers indexing public pages in accordance with
robots.txt; - Bypass, circumvent, or attempt to bypass any rate limit, usage quota, or throttling mechanism of the Service;
- Use the Service in a manner that disproportionately burdens Lecturia's or any TTS Provider's infrastructure.
3.3 Circumventing credit and billing mechanisms
- Create multiple Accounts to obtain additional free-tier grants or otherwise circumvent credit limits;
- Use stolen, unauthorized, or fraudulent payment methods;
- Initiate chargebacks on legitimate purchases with the intent to obtain services without paying;
- Resell, rent, lease, or otherwise transfer credits to any third party;
- Use the Service in any way that disguises the true cost of credits or misrepresents the pricing to any third party.
3.4 Reverse engineering and derivative services
- Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying algorithms of the Service, except to the extent expressly permitted by non-waivable law;
- Use the Service to train, develop, improve, or benchmark any competing text-to-speech, narration, audio-generation, or voice-cloning system or model;
- Extract, scrape, or collect data from the Service to build a competing product, catalog, or dataset;
- Frame, mirror, or resell the Service or any part of it without Lecturia's prior written consent.
3.5 Account sharing and misuse
- Share your Account credentials with any other person, or allow any other person to access your Account;
- Create an Account using false identity information, a name that is not yours, or an email address you do not control;
- Create an Account on behalf of another person unless you are that person's legal representative and you have the right to bind them to the Terms of Service;
- Use the Service if you are under eighteen (18) years of age.
3.6 Misrepresentation of output
- Represent that Lecturia has produced, edited, published, endorsed, or is otherwise responsible for any particular Output;
- Use Lecturia's name, logo, or brand to promote any Content, Output, or derivative work without Lecturia's prior written consent;
- Remove, obscure, or alter any attribution, watermark, or metadata that Lecturia has attached to Output.
4. AI-Specific Restrictions
Because the Service uses third-party TTS Providers and large language models, the following AI-specific restrictions apply regardless of any other provision of this AUP.
4.1 Flow-down from TTS Providers
Your use of the Service must comply with the acceptable use, prohibited content, and usage policies of any TTS Provider you select. Restricted categories commonly include (but are not limited to) deceptive deepfakes, impersonation of real individuals, sexual content involving real individuals, political deceptive content, defamatory content, and the categories prohibited by this AUP. If a TTS Provider rejects your Input or restricts the resulting Output, Lecturia may act on that determination.
4.2 Voice cloning and impersonation
You may not use the Service to clone, reproduce, or simulate the voice of any real, identifiable person, living or deceased, without that person's express, verifiable consent (or, for deceased persons, the consent of their legal representative). The Service does not offer a voice-cloning feature at present; this restriction applies in the event a voice-cloning feature is added in the future or if you attempt to use Output for such a purpose.
4.3 High-risk and prohibited AI uses under the EU AI Act
To the extent the EU AI Act (Regulation 2024/1689) or any equivalent law prohibits or restricts particular uses of AI systems or the outputs of AI systems, you may not use the Service or any Output for any use that is prohibited or restricted under that law, including (for example) social scoring, real-time biometric identification in public spaces outside of narrow law-enforcement exemptions, emotion recognition in workplaces or educational institutions, or any other prohibited practice. You are solely responsible for compliance with the EU AI Act and any other AI-specific law applicable to your use of the Service or of Output.
4.4 Disclosure of AI-generated audio
Where applicable law (including Article 50 of the EU AI Act) requires that AI-generated audio be disclosed as such when used in any public-facing context, you are responsible for making the required disclosure.
5. Enforcement
5.1 Lecturia's response to violations
Lecturia may, in its sole discretion and without prior notice, take any of the following actions in response to a suspected violation of this AUP:
- Remove or disable access to Content;
- Refuse to process a particular Input;
- Retain a hash, fingerprint, or limited metadata of removed Content to prevent re-upload;
- Limit, suspend, or terminate access to the Service;
- Suspend or terminate the offending Account;
- Forfeit unused credits, as permitted by the Terms of Service;
- Report the violation to the applicable TTS Provider, sub-processor, law-enforcement authority, or regulator where required by law or where Lecturia reasonably believes reporting is appropriate;
- Cooperate with law-enforcement investigations, including by preserving and providing Content and Account information in response to valid legal process.
The action Lecturia takes will be proportionate to the violation, with one exception: violations involving CSAM or credible threats of imminent harm to any person will result in immediate Account termination and reporting, without gradation.
5.2 No obligation to monitor; no verification of provenance
Lecturia has no obligation to proactively monitor your Content or your use of the Service, and Lecturia does not verify where, when, or from whom you obtained any Content you upload. In particular, Lecturia does not request receipts, invoices, license keys, or any other proof of ownership; does not inspect uploads for signs of DRM removal or modification; and does not compare uploads against any external catalog of known works or database of known infringing content. The enforcement mechanisms described in this AUP are rights, not duties, and Lecturia's decision not to exercise a right in a particular case is not a waiver of that right in any other case.
This posture is consistent with, and is intended to preserve, Lecturia's eligibility for hosting safe harbor under 17 U.S.C. §512 (including the "no duty to monitor" provision of §512(m)) and Article 6 of Regulation (EU) 2022/2065 (Digital Services Act), and reflects the no-general-monitoring principle of Article 8 of that Regulation. It is not a signal that prohibited uploads are tolerated: the obligations in Section 2 of this AUP bind every User on every upload, and enforcement runs reactively -- through DMCA and DSA notices, abuse reports, TTS Provider reports, automated signals, and the repeat-infringer policy in the Copyright & DMCA Policy -- rather than through upload-time filtering.
5.3 Cooperation with Lecturia's response
If Lecturia notifies you that it believes your Content or conduct violates this AUP, you agree to cooperate with Lecturia's investigation in good faith, including by providing information reasonably requested to help Lecturia assess the situation.
6. Reporting Violations
If you become aware of Content or conduct that you believe violates this AUP, please report it to Lecturia:
- General abuse reports:
[email protected] - Copyright infringement:
[email protected](see the Copyright & DMCA Policy for the required format) - Child safety concerns:
[email protected], mark the subject line "URGENT -- CHILD SAFETY" - Security vulnerabilities:
[email protected] - Law-enforcement requests:
[email protected]
Reports should include enough detail for Lecturia to investigate: the URL, file name, or Content identifier; the nature of the violation; your contact information; and, where applicable, a statement of your good-faith belief that the Content or conduct violates this AUP. Lecturia will use reasonable efforts to investigate credible reports promptly.
7. Changes
Lecturia may update this AUP from time to time to address new abuse patterns, new legal requirements, or new product features. Lecturia will post the updated AUP in the same location as this document and will update the "Last Updated" date at the top. For material changes, Lecturia will provide notice as described in the Terms of Service.
